MWP achieves victory in the Commercial Court of the BVI High Court of Justice

MWP is pleased to announce a decision of the Commercial Court of the BVI High Court of Justice, in the Eastern Caribbean Supreme Court which by judgment and order of the Honourable Justice Wallbank on 29 November 2016, dismissed an application brought by John Forster Emmott against MWP, and awarded costs against Mr Emmott in favour of MWP.

The application was Mr Emmott’s most recent attempt to damage the company he once worked for, and was a fiduciary of, and from within, and at the cost of which, he established the Temujin Partnership, commencing in September 2005. MWP has judgment debts of more than US$12m against Mr Emmott’s two partners in Temujin – Mr R. C. Nicholls and Mr D. R. Slater, as well as Temujin International FZE, supported by on-going freezing and disclosure orders of the BVI High Court, the English High Court, and also of the NSW Supreme Court against them, Temujin Holdings and the PJT Group.
MWP has significant judgment debts of more than US$3m against Mr Emmott’s co-conspirator, business and litigation partner, Mr T. I Sinclair, and on 5 August this year the New Zealand Court of Appeal gave judgment at [2016] NZCA 376 allowing MWP to enforce its judgment debts against Mr Sinclair’s NZ$4m house in Roseneath (see MWP News from 5 August 2016).

The means by which the Temujin Partners can continue their fraudulent conspiracy to injure MWP, are now becoming increasingly restricted.
