Decree of the President of the Republic of Azerbaijan “On some measures in the field of licensing”

On December 21, 2015 the President of the Republic of Azerbaijan Ilham Aliyev has signed decree “On some measures in the field of licensing” in accordance with decree the License regulation, List of licensable activities (except for activities related to national security) and the amount of state duties payable for the issuance of licenses for the relevant types of activities and List of licensable activities related to national security and the amount of state duties payable for the issuance of licenses for the relevant types of activities are approved.

The major points of the License regulation are the following:

1. From now on all licenses will be issued for an unlimited period. Moreover, with effect from 22 December 2015, all current licenses will have an unlimited term of validity.

2. Licenses now shall be issued within 10 days of application (the previous regulations provided for a 15-day period).

3. The Ministry of Economy and Industry of the Republic of Azerbaijan was designated as the state authority responsible for the issuance, suspension, resumption and cancellation of licenses (except for licenses issued for types of activities related to national security) through ASAN centers or the Electronic License Portal.

4. The previous Regulations on improvement of the issuance of special permits (licenses) for certain types of activities, which were approved by the Presidential Decree No. 782, dated 2 September 2002, have now been revoked.

The major points of the List of licensable activities (except for activities related to national security) and the amount of state duties payable for the issuance of licenses for the relevant types of activities are the following:

The number of activities which require a special permit (license) was reduced from 58 to 33, while the amount of state duties payable for the issuance of licenses is reduced by up to 50%.

Hereinafter the following business activities do not require a license in Azerbaijan:

- Production import and sale of ethyl (potable) alcohol and strong drinks: (wine, cognac, vodka and other strong drinks, list of which is established by the Cabinet of Ministers of the Azerbaijan Republic);
- Production import and sale of tobacco goods;
- Passengers and cargo transportation by motor transport;
- Production, turnover, processing and use of precious metals and stones;
- Activity of hotels and hotel type objects;
- Sale of oil & gas products;
- Tourism activity;
- Auditing activities;
- Cartographic activities;
- Manufacturing of strict accounting blanks;
- Customs broker activity;
- Carriage of passengers and cargo by sea;
- Activities of commodity exchange;
- Carriage of passengers and cargo by air;
- The activities on assistance to the Azerbaijan Republic citizens to get the job in foreign countries;
- Installation, set-up and repair of power plants, equipment and facilities;
- Activities of non-governmental social funds;
- Establishment of bonded warehouses, short term storehouses, free warehouses; and
- Construction, reconstruction and repair of fire protection buildings, constructions and premises.

The major points of the List of licensable activities related to national security and the amount of state duties payable for the issuance of licenses for the relevant types of activities are the following:

The List defines four types of activities related to national security which would require a license and establishes the related state duties for the issuance of the license:
• Private security activity (AZN 1,500);
• Designing and manufacturing of information security systems (AZN 1,100);
• Developing biometric technologies and providing maintenance services therefore (AZN 1,100); and
• Creation and establishment of a personal information manager and rendering services therefore (AZN 1,100).

The authorities responsible for issuing licenses for the aforementioned types of activities are the State Security Service, the Ministry of Internal Affairs and the Ministry of Communications and High Technologies.

We consider the above certain measures in the area of licensing positive, because they are improve the business climate and give impetus to the development of entrepreneurship in Azerbaijan.
