Subsoil use rights – What’s new?
On 20 January 2011, changes and amendments introduced to the Rules of Granting Subsoil Use Rights were published in the republican newspaper Kazakhstanskaya Pravda, issue 19-20 (26440-26441). The changes were approved by Order No. 1456 of the Government of the Republic of Kazakhstan On Approval of the Rules of Granting Subsoil Use Rights dated 30 December 2010.
Now, according to the Rules and the Law On Subsoil and Subsoil Use, a new method was added to the methods of granting subsoil use rights apart from through tenders and direct negotiations. Thus, a subsoil use right can be granted on the basis of a contract or the written consent of an authorised body.
A subsoil use right shall be deemed granted and accrued from the effective date of the contract except as required by the Law On Subsoil and Subsoil Use and the Rules. The Order shall become effective in ten calendar days after its first official publishing.
