MWP is granted permission to appeal the judgment and order of O’Farrell J

On 23 March 2017, Floyd LJ in the English Court of Appeal granted MWP permission to appeal the 24 November 2016 judgment of O’Farrell J ([2016] EWHC 3010 (Comm)) in the English High Court.

In granting permission Floyd LJ recorded that MWP’s grounds of appeal have a real prospect of success.

O’Farrell J’s judgment and order granted MWP’s former director and employee, J. F. Emmott, an anti-suit injunction preventing MWP from progressing its claims against him in the Supreme Court of New South Wales, Australia, for joint and several liability for, and obligation to contribute to the judgment debts and liabilities of his Temujin partners R. C. Nicholls (deceased) and D. R. Slater, and for disclosure, an inquiry into and account of the worldwide assets and revenues of the Temujin Partnership from September 2005, to date, including on a proprietary tracing basis. The requirement in the O’Farrell J order to discontinue the NSW SC claims has now been stayed by the order of Floyd LJ.

A successful appeal of the O’Farrell J judgment and order will allow MWP to progress its claims against J. F. Emmott in the Supreme Court of New South Wales in an effort to reverse the effect of the fraud committed by Emmott and his Temujin partners, and to retrieve the 67% of the worldwide assets and revenues of the Temujin Partnership of which MWP has owned two-thirds since October 2015 and March 2016.
