We have extensive experience commencing fr om 1994 to date in representing our clients in trademark prosecution and opposition matters, including trademark, brand enforcement, licensing, franchising, e-commerce, copyright, domain names, right of publicity, social media, privacy, internet law, and advertising compliance.
MWP acted as a key legal adviser in the following projects in Central Asia and the Caucasus:
• Trademark and patent searches, applications filings, renewals, changes of title, recordal of assignments and licenses, protection and obtainment of domain names, IP right infringement monitoring and investigations, oppositions, appeals, analysis of existing and drafting of new franchising and distributorship agreements, brand protections, non-use cancellation action and overcoming provisional refusal of the clients.
• Drafting and negotiating various kinds of contract, consulting on labour issues (such as employment of foreign employees, bonus payments, termination of employment, including due to the staff redundancy), advising on implementation of employees’ incentive schemes, supporting in implementing personal data protection laws and regulations, advising on and assisting with obtaining work permits for foreign employees, assisting in employment dispute resolution, analysis of existing and drafting of new employment, collective employment and confidentiality agreements; advising on currency regulation and currency control issues, advising on licensing for professional activities on the securities, investment fund and insurance market, advising on regulation of brokers/dealers, investment funds, insurance companies, and other professional participants of the securities and financial markets; advising on the most suitable form of legal presence (i.e. a limited liability company, joint stock company, branch or representative office) to perform the business; advising and establishing joint-ventures and subsidiaries, drafting all necessary resolutions and foundation documents, advising and providing support during re-registration, reorganisation, liquidation and bankruptcy procedures, advising on corporate governance issues, including on directors’ duties and liabilities, board composition and general corporate policies, drawing up the internal legal documentation, including resolutions required for annual general meetings and other shareholder/participant meetings and communications;
